Under section 7 of the Education Act (1996) England and Wales. it is the parent/carers duty to cause the child to receive efficient and full time education suitable to his/her age, ability and aptitude and to any special educational needs he/she may have, either by regular attendance at school or education otherwise.
Elective home education is the “education otherwise” part of the Education Act (1996) England and Wales.
There is no legal duty for parents to ask the Local Authority for permision to home educate. Although if a child is on roll at a school, parents will need to deregister their child from the school by writing to the Head Teacher or Proprieter.
